SuffolkWeb Software Utilities Waiver of Liability

SuffolkNet/SuffolkWeb service is intended to be "an extension of the local library's service program." As such, it should not be construed to be a full Internet Service Provider (ISP). The purpose of this service is to assist the patron's independent research by providing increased access to information. Other services of SuffolkNet are secondary to this purpose. This is clearly compatible with the traditional role of the public library.

In order to fulfill this role the SuffolkNet project offers two significant services to the patron beyond basic Internet access. First, it provides a few basic tools (software) to assist the patron to connect to the Internet. Secondly, it provides a professionally developed searching tool (SuffolkWeb Home Page) to help the patron find the information they seek in an efficient manner. We also recognize the growth of e-mail as an effective means of communication and information sharing and will continue to support it as an important outgrowth of our primary service as a research tool. SuffolkNet is a great place for research and an easy way to get acquainted with the Internet. It is not intended to compete with commercial Internet Service Providers. Sophisticated users may well consider these other services.

The SuffolkWeb Internet Utilities package has been provided to the Suffolk Cooperative Library System and its member libraries for free distribution to library patrons registered with the SuffolkNet Internet Gateway without obligation. In return, the Suffolk Cooperative Library System has agreed to display the Microsoft Internet Explorer Online Logo on the SuffolkWeb home page. This software may not be sold or redistributed in any format.

No Warranty: Any use of the "SuffolkWeb" software product is at your own risk. The product is provided for use only with Microsoft operating system products. To the maximum extent permitted by applicable law, Microsoft, the Suffolk Cooperative Library System or its member libraries disclaim all warranties and conditions, either expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

No Liability for consequential damages: To the maximum extent permitted by applicable law, in no event shall Microsoft, the Suffolk Cooperative Library System or its member libraries be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product, even if Microsoft, the Suffolk Cooperative Library System or its member libraries have been advised of the possibility of such damages.
